Arizona Rideshare Laws

Rideshare services, often associated with companies like Uber and Lyft, have become increasingly popular as an alternative to traditional taxis. In Arizona, rideshare services were regulated under state law, with the primary legislation being the "Transportation Network Company" (TNC) statute.

TNC drivers must be at least 25 years old,  have a valid license, and undergo background checks. These checks would typically look into criminal history, driving records, and other relevant information.

Rideshare drivers are subject to a vehicle inspection.

TNC Insurance Requirements in Arizona

Rideshare drivers are required to obtain the proper insurance coverage while logged into the Uber or Lyft app or transporting passengers on behalf of a rideshare company. If an insurer discovers that a Uber or Lyft driver conducts business under their Personal Auto Policy (PAP), they can cancel the policy.

During the period when the rideshare driver is ready to offer passenger transportation, either through a mobile app or by picking up passengers on the street, but has not yet accepted a ride request and is not actively engaged in transporting passengers, they are required to have a motor vehicle liability insurance policy that provides coverage as follows:

  • $25,000 for bodily injury or death of a single individual in any given accident, up to the stated limit for one person.
  • $50,000 for bodily injury or death of two or more individuals in any single accident.
  • $20,000 for property damage or destruction in any single accident.

Once the TNC driver accepts a ride request using any form of communication and is actively transporting passengers, both the TNC driver and the TNC company are obligated to maintain the following insurance coverage:

  • A motor vehicle liability insurance policy--or a modification or addendum to an existing policy--that offers a minimum of $250,000 of coverage per incident.
  • An addendum or modification for uninsured motorist coverage with a minimum of $250,000 of coverage per incident.

However, when the app is off, drivers must have $15,000 for bodily injury to one person, $30,000 for bodily injury or death of two or more individuals, and $10,000 for property damage or destruction in any single accident.

Who is Liable in an Uber or Lyft Accident in Arizona?

In Arizona, liability in a rideshare accident can involve several parties, including:

  • The Rideshare Driver: If the rideshare driver is at fault for the accident due to negligence, recklessness, or any other form of driver error, they can be held liable for the damages. Rideshare drivers are expected to follow traffic laws and drive safely.
  • Rideshare Company (Uber, Lyft, etc.): Rideshare companies are generally considered to be Transportation Network Companies (TNCs). In many cases, they can be held liable for accidents caused by their drivers while they are actively engaged in transporting passengers (when the app is on and they are looking for passengers or transporting them). Rideshare companies often provide liability insurance coverage during this period.
  • Other Drivers or Parties: If another driver or party is responsible for the accident, they can be held liable for damages just like in any other car accident case. This could involve other vehicles, pedestrians, cyclists, or any other party contributing to the accident.
  • Vehicle Manufacturers: If a defect in the rideshare vehicle contributed to the accident, the vehicle manufacturer might be held liable for damages caused by the defect.
  • Government Entities: In some cases, poor road conditions or inadequate signage could contribute to an accident. If these conditions were caused by government negligence or failure to maintain roads properly, a government entity might be held liable.
  • Passengers: In some instances, passengers' behavior or actions could contribute to an accident. If a passenger's actions directly lead to the accident, they might be held partially liable.
